I can get testimonies or written statements from the entire staff stating my boss would only discipline me and not others, even if they were doing the same thing at the same time, right next to her, i have several specific examples of this. My friend who is the Assitant manager heard from the manager, he didnt want to hire any more Men (showing grounds of possible sex discrimination). The entire staff made jokes everyday about how much my boss hated me, etc etc. She even admitted to me in front of another employee, she "may have tended to favor the other japanese associates over me" and that shed rather "put the better japanese sellers in (even though im semi fluent in japanese myself) rather than schedule me" well, I am a full time employee, in their own guidebook it means i am guaranteed at least 30 hours a week, my boos has been giving the part timers my hours and not scheduling my 30 hours (breach of contract)... the company is also based out of NY (where verbal contracts are binding, or so ive heard). Shes told me she was cutting my hours because we didnt have enough payroll, yet she hired on two new staff and gave them full time hours. I was the only full time staff person she would put "on call" to come into work. (getting less than my 30 hours again). The HR lady sounded scared when i told her i was talking to a lawyer about all of this. she tried to give me the mumbo jumbo about the reason my hours were cut was because of my availability (which hasnt changed in 3 months) but IS different than what i had on my original application. I told them when i was hired that my schedule would change with school... then i told her my school schedule my boss said she would give me a set schedule and keep me full time. I had the set schedule for 2 months, then she claimed it was "too hard to schedule around me" (basically she had gotten lazy) I knew they were trying to cut my hours and make me look bad. We get reviewed by sales per hour, etc. When there was grunt work (like helping with shipment) id be the first volunteered by management to help in the stock room for the rest of the day (meaning my SPH would go to shit, 8 hours of selling NOTHING doesnt help much). I realized what they were doing, but My numbers were still above average. Anyway, several other employees think they have been singled out as well and want to join in my lawsuit. I think I have them on having a "hostile work environment" and discrimination easily. I have tons of evidence there. As for breach of contract i dont know if they can weasel out or not, but we'll see. whatcha think?
